NOTICE TO USER: PLEASE READ THIS TERMS OF SERVICE AND PRIVACY POLICY (“AGREEMENT”) CAREFULLY BEFORE CREATING AN ACCOUNT OR UPLOADING ANY CONTENT. BY CREATING AN ACCOUNT, CHECKING THE CONSENT BOX, OR USING THE APPLICATION, YOU AGREE TO BE BOUND BY ALL TERMS CONTAINED HEREIN. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE APPLICATION.
1. Account Registration & Agreement Scope
This sports technique analysis application (the “App”), operated by Justin Kiefel, doing business as RedFrog Sports Technology (“Company,” “we,” “us,” or “our”), provides automated video processing and movement feedback. This Agreement governs all users, including early-access testers, beta participants, and general public users.
2. App Availability & "AS IS" Disclaimer
Active Development: The App (including all features, updates, analytics, and content) is provided to you on an “AS IS” and “AS AVAILABLE” basis. The App is under continuous development, is free of charge, and may contain bugs, errors, or inaccuracies.
No Guarantees: We make no warranties, express or implied, regarding the reliability, availability, accuracy, or uninterrupted operation of the App. We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice, and shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
3. Video Submissions & License Grant
Grant of License: By uploading, submitting, or transmitting any video, image, or audio recording (“User Content”) to the App, you grant Company a non-exclusive, worldwide, royalty-free, fully paid-up, transferable, and sublicensable license to host, store, stream, reproduce, modify, analyze, adapt, create derivative works from, and otherwise use your User Content solely to:
Process movement and generate technique feedback for your account;
Research, train, tune, validate, and improve Company’s artificial intelligence, machine learning, and computer vision models; and
Support quality control, system maintenance, and product development.
Third-Party Content & Permissions: You represent and warrant that you own all intellectual property rights to any User Content you upload, or that you have obtained express written permission from every individual (or their parent/legal guardian if a minor) who appears in or is identifiable within the User Content.
4. Biometric & Computer Vision Data Processing Notice & Explicit Consent
Nature of Data Collected: When you submit a video, the App utilizes automated computer vision algorithms to detect, track, and map keypoints of the human body (e.g., joint positions, angles, skeletal posture, spatial movement).
Biometric Identifier Disclaimer: Depending on applicable local laws, keypoint extraction, body pose tracking, or movement geometry may be classified as biometric data or biometric identifiers.
Purpose & Retention: Body keypoint data is extracted solely to generate movement feedback and improve our motion analysis algorithms. Company will retain raw videos and extracted keypoint data only for as long as necessary to fulfill product development and model testing purposes, or until you request account/data deletion, after which data will be permanently deleted or anonymized.
Explicit Consent: By accepting this Agreement, you provide explicit, affirmative written consent for Company to extract, collect, store, and process body geometry, keypoints, and related video metrics as described herein.
5. Age Requirements & Minors (COPPA & Guardian Consent)
The App is intended for individuals who are at least 18 years of age.
If an athlete or user is under 18 years of age (a “Minor”), a parent or legal guardian must review and accept this Agreement on behalf of the Minor prior to account creation or video submission.
If the Minor is under 13 years of age, explicit parental consent is required prior to collecting any personal information or video recordings, in compliance with the Children’s Online Privacy Protection Act (COPPA).
6. Medical, Coaching & Physical Injury Disclaimer
Informational Purpose Only: The App-provided feedback and movement stats are generated by automated software for educational and informational purposes only. The App does NOT provide professional coaching, medical advice, physical therapy, or diagnostic evaluations.
Assumption of Risk: Athletic activities involve inherent risks of physical injury. You assume full responsibility for any physical injury, property damage, or loss incurred while engaging in athletic movements or implementing technique adjustments suggested by the App. Always consult a qualified medical or sports healthcare professional before beginning any new athletic training regime.
7. Data Storage, Security & User Rights
Data Storage & Transit Security: All communications and video uploads between your device and our application are encrypted in transit using Secure Sockets Layer (SSL) / Transport Layer Security (TLS) protocols (HTTPS). Data and User Content are currently hosted, processed, and stored on our local development infrastructure.
Security Limitations: While we employ reasonable technical and operational measures to protect your information, no local hosting environment or transmission over the internet can be guaranteed as 100% secure. You upload User Content at your own risk.
Account & Data Deletion: You may request deletion of your account, raw videos, and associated keypoint data at any time by contacting us at [email protected]. We will process and delete your stored files in accordance with applicable data privacy laws.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR ANY SUGGESTIONS PROVIDED BY THE APP.
